The law is the set of rules established by the courts to facilitate social relations between men. They generally determine the conduct of man in society. Law is normative and sanctioned as a last resort by public force. It manifests itself in different formal sources such as laws, directives, conventions and decrees. These rules are interpersonal and must be enforced. It is therefore essential that everyone knows their rights in order to live better in society. The law comes mainly from four sources: custom, doctrine, jurisprudence and texts. It should also be mentioned that the law is based on the principle of solidarity, the protection of each individual, the principle of equality and the maintenance of peace. In general, law is divided into two main categories: private law, which sets the rules between individuals, and public law, which concerns the public authorities. These two main categories are divided into several branches, for private law there is labour law, commercial law, civil law, private community law and private international law. For public law, there is administrative law, criminal law, tax law, constitutional law, public community law and public international law. The function of law is to harmonise life in society and to express the values of the society that created it. In order to know the legal information related to each of these rights, it is essential to study law at universities. Law studies give access to a wide range of professions such as lawyer, company lawyer or civil servant, but lawyer is the most sought after profession.

Why we are the Melbourne criminal defence lawyers for you? - We are one of Melbourne’s leading criminal law firms. - We only practice criminal law. Nothing else. That is what makes us experts. - Tony was one of the first Victorian criminal lawyers to be recognised as an Accredited Specialist - We only offer honest and straightforward advice and case assessments. - We charge lump sum fees where possible so there are no hidden surprises. - We work regularly with Melbourne’s leading senior Barristers and QCs The outcomes of criminal matters have significant impacts upon peoples’ lives. At the highest, it may result in a period of imprisonment. In other cases, careers, livelihoods and reputations might be at stake. Whatever the circumstances, sentences will bear upon the accused and often their family and friends for the rest of their lives. Why is experience important? Even though each case will present its own set of circumstances and issues, it is likely to share some basic elements with other matters which have been previously heard before the Courts. A lawyer who has dealt with similar matters before will be aware how to best navigate a path to a successful outcome. Whilst every client we see is unique in what has occurred, there are very few, if any, offences that we have not dealt with before in over 35 years of criminal defence work. Complimenting experience is knowledge. Not only is it important to engage a lawyer who has dealt with similar matters, but also one who remains up to date with legal developments such as amendments to legislation and case law. This is particularly important for offences such as digital crimes where the landscape changes rapidly. We are subscribed to a number of law bulletins and receive hard copy legislative updates to ensure that we are fully equipped to deal with any matter. These elements combined means that we are confident in our advice and the decisions that we make, and that we are able to give you a reliable prediction of the likely outcome of a case. Finally, years in the industry builds rapport with other parties in the system such as the Court, Prosecutors and experts who defence solicitors engage to support their cases. Hiring a lawyer with these networks and connections maximises your chances of obtaining the best result. The experts we use all have strong reputations with the Courts and we share excellent working relationships.

Training and studies to become a lawyer

A university course in law and a state diploma in law are required to work as a lawyer. Every year, many students start studying law after the baccalauréat. Once the baccalaureate is obtained, it is possible to have a law degree at the university which confers a bac+3 level. In the second year, the student will have the choice to specialise in private law or public law. This choice will determine the type of lawyer he or she will be. After the law degree, the student must then go on to the Master of Law, which lasts two years and allows the student to specialise in different branches of law. The student must have theoretical and general knowledge of a large number of disciplines including tax law, labour law, business law, international relations or European law. After 5 years of legal studies, the student will obtain the Master of Law degree and has to follow an 18 to 24 months training to obtain the Certificate of Aptitude to the Profession of Lawyer (CAPA) which will allow him/her to register at the bar and become a lawyer. The training takes place at the National School of Magistrates (ENM), the National Institute for Advanced Studies in the Judiciary (INHESJ) or the Regional Centre for Professional Training of Lawyers (CRFPA). It is also possible to take a DUT (Diplôme d'études supérieures de langue juridique), which will be taught at a University Institute of Technology (IUT), an MBA, a DEA or a DESS to become a lawyer. In this profession, it is essential to have great analytical and writing skills as well as good methodology and organisation. A lawyer must be able to synthesise and memorise the main ideas and must be able to reason logically. A high capacity for work and oratory is also an asset for becoming a good lawyer.

The areas of intervention of a general practitioner

The lawyer is a legal professional who is able to defend, advise, assist, plead and represent his clients before a judge, depending on his field of law. His clients may be legal entities or individuals. He is able to handle tax, labour, family and property matters. He can also protect children (children's rights) and defend the environment against human aggression (environmental rights). He can also take charge of criminal, misdemeanour, commercial and financial cases. The lawyer can also advise in various legal proceedings. Indeed, the lawyer can represent his clients before the courts in order to solve their everyday problems (labour law, family law, criminal law, etc.). They can work independently or within a legal structure such as a law firm or a company's legal department. He is also able to perform several functions as a legal adviser and defence counsel.

Why use a lawyer?

As the roles of the lawyer are many, there are many reasons to seek his services. He is able to advise and inform the client on any legal issue in the legal field to be dealt with. He can guide his clients so that they have a chance to win the case. He can negotiate an out-of-court settlement in case the case takes a different turn. He will do everything possible to ensure that his client gets the right he deserves (low fine, less years in prison, etc.). In addition, he is able to accompany his clients in every procedure and inform them about the success rates of their situation. The main objectives of a lawyer are to prevent, guide and clarify his client before going before the judge. They ensure the confidentiality of client reports. In addition, he has the necessary skills to defend the client's interests and to plead before the court. He knows how to act and advise his client from the beginning to the end of the trial on the strategy to be implemented in relation to the situation. In addition, he can also take charge of the drafting of various legal documents (transaction, company statute, commercial lease, etc.) and contracts for a company. His services are intended for individuals, companies and professionals.

When to call a lawyer?

During a police custody or an arrest, it is strongly advised to hire a lawyer. He or she will be able to take charge of the investigation file and obtain investigations from the investigating judge. The presence of a lawyer is also very important when a small dispute arises. As an expert, he can intervene in the field of family law (divorce, real estate law, personal law, etc.), civil and commercial contract law, social law (social security law and labour law), construction law and criminal law (offences, breach of trust, fraud, trade union discrimination, sexual harassment, etc.). It is possible to engage a lawyer before the local court, the industrial tribunal, the criminal court, the commercial court, the police court and the district court. The lawyer is also prepared to intervene in the court of cassation in an administrative court or a high court.

How to find a lawyer?

There are several ways to find a lawyer in Moonee Ponds, for example the websites of the bar associations in the jurisdiction, the directory of the national bar council or the lawyers' websites. It is also easier to find a good lawyer through the StarOfService directory. All you have to do is choose the right professional and follow the various steps.

What are the fees for a lawyer?

On average, the use of a lawyer's services costs around €150 for a consultation and varies according to the reputation of the lawyer's firm, the type and complexity of the case and the expertise of the lawyer. For example, a civil case tried in a court of law costs between €800 and €1,000, whereas a case where the stakes are over €10,000 costs between €2,000 and €3,000. In a criminal case, it may be difficult to determine the price, especially in a criminal case. The price for a criminal case can be as high as €6,000. In business law, the hourly rate of a lawyer is about 150 HT and can rise to 800 €/h HT if it is a renowned firm. For divorce, the cost of the case is between €2,000 and €8,000. This can rise further depending on the complexity of the case.

How to choose a lawyer?

- It is important to know why a lawyer is needed, as some lawyers specialise in legal advice while others focus on litigation and court defence. If it is not possible to know the field of the lawyer to be involved, opt for a general lawyer. - It is important to check that the lawyer has the necessary skills to handle the case. Opt for a lawyer who is competent in a particular area of law. Ideally, consult the lawyer's online profile or the law firm directly to find out their areas of expertise and reputation. - Hire a local lawyer to reduce travel costs. It also allows for good communication and easy access to appointments during complicated times. It is best to choose a lawyer with a good reputation. - It is also essential to get on well with the lawyer. It is important to know whether the lawyer is a good listener, a good teacher and a professional. The lawyer must be able to explain the details of the case in detail and must have defence strategies. They must also be available and keep up to date with the progress of the case. - The lawyer must have at least a Master's degree and the CAPA or other qualifications that qualify him as a lawyer. Human and interpersonal skills as well as legal knowledge are important to ensure a trusting and healthy relationship. - It is important to know the lawyer's fees. This is an essential criterion in the choice of a lawyer. The lawyer must be transparent about his fees. Most lawyers adapt their fees to the complexity of the case. This is why it is advisable to ask for an estimate at the first meeting.

Questions to ask a lawyer during the first contact

- Do you specialise in legal advice or litigation? - How many years have you been in this profession? - What are the different cases you have handled? - Are you listed in the directory of the Conseil National des Barreaux or in the lawyers' networks? - What is your degree? - What are the procedures to follow for my case? - What are my chances of winning my case? - What are your fees?
